Senior attorney Kapil Sibal argued in the Supreme Court on behalf of the Shiv Sena's Uddhav Thackeray faction that the Eknath Shinde faction cannot assert that it is the original party. "You are not allowed to identify as the political party. And you claim to represent the Guwahati-based political party. Election Commission decides which political party to support. In Guwahati, you cannot declare sitting.
The Uddhav side's senior attorney, Abhishek Singhvi, stated that the Eknath Shinde camp's only viable defense is a merger with the BJP which they are not claiming.
The petitions about the political situation submitted by the Eknath Shinde group and the Uddhav Thackeray faction in Maharashtra were heard by a bench made up of Chief Justice NV Ramana, Justice Krishna Murari, and Justice Hima Kohli.
Harish Salve, speaking on behalf of the Eknath Shinde group, said: "In India, we conflate some leaders with political organizations. I'm a Shiv Sena member. My chief minister won't meet with me. I desire a different CM. This is intra-party, not anti-party."

Salve claimed that party members who support Eknath Shinde haven't renounced their membership and that skipping a meeting isn't the same as cancelling one.
The chief minister (Uddhav) resigned, not because he lost the floor test, according to attorney Mahesh Jethmalani, who was speaking on behalf of the Shinde side. It must be assumed that a chief minister lacks the majority if he declines to take the floor test, he said.
The CJI postponed the case to tomorrow so that the legal concerns involved might be resolved.
